A former security guard who accused American Security & Protection Service LLC of failing to pay workers for time between shifts lost her appeal Friday, when the Sixth Circuit said she hadn’t explained what happens during the time in question.

Marsha Forrester’s failure to describe what tasks are completed during “pass down”—the 10-15 minutes security guards are required to be present between shifts—is fatal to her claim that American Security wrongly failed to pay workers for this time, the US Court of Appeals for the Sixth Circuit said.
