India begins anti-dumping duty sunset review probe on aluminium foil imported from China


India has begun a sunset review investigation on imports of Aluminum Foil 5.5 Micron to 80 Micron from China based on an application filed by Hindalco Industries Ltd, Raviraj Foils and Jindal India Ltd.

The Directorate General of Trade Remedies (DGTR) said that there is likelihood of continuation/recurrence of dumping and injury to the domestic industry in the event of cessation of the anti-dumping duty. The current anti-dumping duties are in force till May 15, 2022.

The foils are used extensively for protection, storage, and preparation of foods and beverages, pharmaceutical packaging, cigarette industry for wrapping cigarettes, tabaco pacing (Gutkha), and beer bottles.

“There is prima facie evidence of likelihood of continuation/recurrence of dumping and injury to the domestic industry in the event of cessation of duty, considering the volume and price of imports of subject goods from subject country, positive dumping margin, significant unutilized capacities in subject country, existence of trade remedial measures imposed by other countries against the subject country, potential trade diversion, and price attractiveness of Indian market,” DGTR said in a notification.

It said that the applicants have alleged that dumping from China has continued even after the imposition of anti-dumping duty and that there is likelihood of continuation or recurrence of dumping and injury in case of cessation of duties.

The injury period of investigation will, cover the periods 2017-18, 2018-19, 2019-20 and FY21.

The notification comes a day after the finance ministry imposed definitive anti-dumping duty on “Aluminium Foil” (of thickness of 80 microns and below) imports from China, Malaysia, Thailand and Indonesia.
